1. Services Description & No Fiduciary Relationship

CC Financial Solutions LLC provides educational and professional financial consulting, credit profile guidance, and business funding readiness assessment.

No Guarantees: We do not act as an extension of credit, a direct lender, or an institutional credit bureau. We explicitly do not guarantee capital funding approvals, specific credit score point increases, or third-party underwriting outcomes. All assessment profiles are evaluated on an individual, case-by-case basis.
No Fiduciary Duty: Completion and submission of any online pre-qualification funnel form does not establish a contract for services, an obligation to fund, or a fiduciary client relationship.
Non-Refundability: To the extent that any consulting, analysis, or evaluation fees are collected, all such transactions are strictly final and non-refundable.

2. User Representations & Fraud Prevention

By submitting any intake or pre-qualification form through our digital interfaces, you warrant under penalty of perjury that:

All information, asset values, corporate entity designations, and revenue numbers provided are 100% accurate, truthful, and current.
You are an authorized legal representative of the commercial business entity seeking capital.
You are the authorized legal subscriber of the telephone number and email address submitted. Providing false, spoofed, or un-owned data will result in immediate termination of service and potential civil liability.

3. Mobile Messaging Terms (A2P 10DLC Compliance)

By checking the explicit consent checkbox on our web forms and providing your mobile telephone number, you provide your express written consent to receive automated SMS alerts, marketing updates, pipeline updates, and follow-ups from CC Financial Solutions LLC.

Program Purpose: Messages will be sent to follow up on your pre-qualification form, provide evaluation status updates, or coordinate scheduling for financial consulting calls.
Message Frequency: Message frequency varies depending on your application activity, funnel interactions, and pipeline status.

4. Mandatory Individual Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the use of our digital funnels, or the receipt of any A2P text messages or voice communications from CC Financial Solutions LLC shall be settled exclusively by final and binding individual arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA).

You expressly waive your right to litigate claims in court before a judge or jury.
All claims must be arbitrated on an individual basis. You explicitly waive any right to initiate, join, or participate in any class action lawsuit, class-wide arbitration, or representative legal proceeding.
This section is governed strictly by the Federal Arbitration Act (FAA).

5. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall CC Financial Solutions LLC, its corporate officers, directors, employees, or independent contractors be liable to you or any third party for any direct, indirect, special, punitive, incidental, or consequential damages (including, without limitation, lost business profits, loss of data, credit denials, or inability to secure financing).

Liability Cap: In the event that CC Financial Solutions LLC is found liable under any legal theory, our total aggregate liability shall not exceed one hundred dollars ($100.00 USD).
Indemnification: You agree to indemnify and hold harmless CC Financial Solutions LLC from any claims, losses, or TCPA/regulatory penalties resulting from your submission of a telephone number or data profile that you do not legally own or control.

6. Governing Law and Venue

These Terms and Conditions shall be governed by, interpreted, and enforced strictly in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any legal arbitration hearings or permitted judicial proceedings shall take place exclusively in the state or federal courts located in or nearest to Elba, Alabama.
